Senator State Senatorsenator

Good morning. Today is Monday March 23, 2026. I'm Senator State Senator Jamal T. Bailey, Chair consent standing committee on insurance. Happy March Madness. Hopefully your brackets are not in shambles like mine are. We have a six month agenda. We have been joined by our ranking members and helming senators Scoofis, Adabo, Harcom and o'.

Senator Jamalsenator

Mara.

Senator State Senatorsenator

With that being said, we will get immediately to our agenda as there are many members moving around as it is budget time. The first bill of our agenda. Senate current 2334 by Senator Rivera.

Senator Riverasenator

An act to amend the insurance law and the social services law in relation to insurance coverage for dental night guards.

Senator State Senatorsenator

Any discussion?

Senator Jamalsenator

I do have a question, Senator Hunt. Is this bill exclusively applied to standalone dental plans?

Senator State Senatorsenator

I know regards to dental guards that are not covered and usually so the base coverage will not cover the dental guards.

Senator Jamalsenator

I think there's some question on whether or not this would apply exclusively to dental plans or if it would be a mandate in addition to New York's essential health benefits and if the fiscal impact, the full cost would fall on the state.

Senator State Senatorsenator

I can get clarification knowing that this bill passed, I believe the Senate last year. The full Senate. This bill did pass the full Senate last year, yes.

Senator Jamalsenator

Do we have a fiscal on this bill?

Senator State Senatorsenator

I can check on that too. Not sure, Senator. So this bill would not have a fiscal impact to the state Medicaid and commercial insurance plans largely already covered this out of practice. This would just be in essence codifying it.

Senator Jamalsenator

So I have to ask, maybe it's a naive question, but who pays for Medicaid?

Senator State Senatorsenator

The state Medicaid in practice already covers these dental cards though.

Senator Jamalsenator

Then why is this bill necessary and this bill? So it's most. This bill only codifies requires commercial insurance to cover. So this doesn't touch Medicaid. And. What was the second part of your question, Senator? My first question was does this bill exclusively apply to standalone dental coverage? No, not standalone dental coverage, but all commercial dental coverage. So it's going to mandate that all commercial plans cover. Yes. The dental guards. Yes. And who's going to pay for that? The commercial plants will. Who pays for the commercial plans that does that get pushed down to the plan participants? Those who subscribe. Does it get rolled into the premium cost? That's for the plants to decide.

Senator State Senatorsenator

Yeah.
