They're actually manning the sportsman's lunch today. In addition to their service, these young individuals are taking the opportunity to engage directly in the civic process. For more than two decades, Be Well has addressed the social determinants of health, working alongside residents, family schools, small businesses, faith organizations, health care providers, and other neighborhood partners to address the root causes of health disparities through policy, systems, and changes to the built environment. The organization has raised and or leveraged more than $50 million to advance healthy living in Colorado communities, helping to connect families to critical supports while amplifying the lived experience of communities too often left out of decision making. As a result of Be Well, residents and communities have seen economic mobility through training and certificate programs, including community health worker certification and increase parks and recreational spaces, the implementation and enforcement of equitable policies that support well-being, improved access to health care and prevention services, and access to affordable, healthy foods, among various other benefits. So in Judiciary, we ran about 50 pages of amendments. and some other amendments too. And the committee approved all of those. They did a bunch of different things. They changed, moved some sections around and struck some parts of the bill and added some other parts to the bill. And I asked for a yes vote. Is there any further discussion

Thank you, Mr. Chair. Colleagues A heartfelt thank to my co from Boulder I I know this is one of her passions many passions here but she asked me last summer last fall given some of the occurrences that unfolded last summer that really elevated this to a point of we knew we had to act. and to watch the effort that went into creating the introduced bill, double-sided, 197 pages, I think, was just phenomenal. The drafter, Shelby Ross, I don't know if I'm supposed to say her name on the floor, but just an exhaustive effort to get us to a spot trying to solve a real problem, A real problem where we don't really offer and treat folks that need treatment and help in this space, and they end up in the criminal justice system. And then at times they end up released because if you're incompetent and unrestorable, historically we just threw our hands up and let people go. And last summer it kind of came to a head, and we've been doing this for decades. So to have to watch the district attorneys and the public defenders dig into this bill, this concept, for really the last six months to get us to where even today, my co-sponsor referenced the amendments we offered in judiciary, amendments in appropriations, and we have amendments on second reading to get us hopefully to a really good spot in this bill because this is a necessity. this is one of those occurrences we have to act. We cannot allow the status quo to continue. And I know there's at least another amendment or two coming from colleagues in the audience that are going to help us improve the bill incrementally every time we've done this. So this is such an important policy conversation and will impact people's lives and public safety immensely and and ask for your support for Senate Bill 149.

Okay, I feel kind of tall today at the conclusion or at the, maybe not the conclusion, but a very important stage for this bill that we have been working on all through the interim and all through this session. And the subject is about people who are not competent to stand trial. And in the United States, We don't allow you to stand trial if you don't have any idea what's happening and if you can't assist and participate in your own defense. And that's a very important civil right that we have to maintain. But it has left us in a bad place in terms of what do we do when people are incompetent to proceed and are not likely to get restored in the foreseeable future. What should we be doing? And we have a process of civil commitment. But for a lot of the people who are involved in this system, that hasn't worked. Because we haven't had adequate placements, and we haven't had the right kind of placements, because there are a variety of reasons why you may not be competent to proceed. It isn't always that you have a serious mental illness. It can also be because you have a brain injury or a neurocognitive disorder, or you have Alzheimer's, or you have an intellectual or a developmental disability. So the bill sets up pathways for these people to get into placements. And it's really focused on the people who are very dangerous. And part of the reason this came to a head in the way that it did is because there was a lot of media attention around some very high cases of people being released back into the community because we had no place to send them And those people then re-offended. Some people got killed. Some people got... We terrorized some kids on a playground. We let free a man who had been in the criminal justice for 10 years, having re-offended multiple times over those 10 years. And finally, the news media honed in on this, and some famous people tweeted about it, And then we decided we could actually put the resources into fixing this problem. And that's what this bill is about. And I encourage a yes vote on the bill.

All right. Thank you, Mr. Chair. Before I do have an amendment to offer and before I offer that amendment, I just want to say a few words first of all. Thank you. Okay, thank you. Anyways, I want to say thank you to the bill sponsors. I know just from my time sitting on the Joint Budget Committee, listening to everything that Senator Amobley and Senator Simpson have been going through with this bill over the course of the last, now I think close to eight months, has been tremendous. And they have done a great job and they have served us well in representing us as a body to get to a fix. I think we all understand what had happened earlier. you know we passed a bill back in 24 realized after implementation that as the good senator from boulder talked about that maybe it didn't work so well and we thought maybe there would be a quick fix and we found out that's not right but we're doing what we do as legislators which is be responsible and understanding that when maybe things didn't go the way we thought they were going to go in a bill that we need to come back and fix it and that's what's going on in this bill and I for one am just greatly appreciative of the efforts of both of the good senators, one from Boulder, one from the San Luis Valley that have come in to fix this bill and I know, I know you've all put a lot of time into it. For me this bill was about in my county, my sheriff came out and talked about and he was the one that got very vocal and where we realized how bad things were going. Came out and talked about a person who had been arrested for some pretty violent crimes was going to get released because he was both unrestorable and incompetent. And he got released, and within 10 days or so, a week or so, he came back and was at the university with a gun threatening to kill people. So that's why this bill is so important, is that we fix that, that those individuals, instead of being released, that we are doing our responsibility in the state to ensuring that we are funding the placements that are necessary for them to get the assistance and the help that they need and that we keep our community safe. So for me that's where this came from and why I am a yes vote, a definitely yes vote on this bill. With regard to the Appropriations Committee report and the appropriations, it's, we got Amendment, or we got the fiscal note fairly late because, again, there was so much movement going on with this bill, so I'm not trying to criticize anyone, please. I appreciate all the work, all of the staff, whether it's the drafter, the fiscal note analyst, or the JBC staff person who was involved in all this. I mean, they were working, I think, through the night to get this fiscal note to us. So, henceforth, I was working through the night last night with the two good senators that are on this bill to go through the fiscal note. And there is a situation in here where, I mean, I understand that there may be some need for some judicial officers with requirement to the bill and the changes that have been made in the bill. But there's a lot of assumptions that are made that we just don't know. So I actually have an amendment. There is an amendment at the desk. to fix the assumption portion of this and still allow for judicial to go through the normal budget process should their assumptions come true.

Would you like to tell us about the amendment?
Yes, I would. Thank you, Mr. Chair. Again, what this does is it doesn't stop the judicial branch from going through the process. It just says, look, let's get some time here and here and make sure that you do have an understanding of what the impacts are from this bill. And then you can go through the normal budget process to ensure that you get, if necessary, any additional staff. So what it does is it does reduce by half, because I'm pretty sure there is no way that the judicial department can hire 24 FTE in a month's time. because that's what they're asking for in the first year. It cuts them in half saying that they have, they still have the year to go out and start hiring people, but they have the year to go out and hire at least half of those individuals. And then if they need to, when we go through the budget process next year, they have the ability to come in and talk to the Joint Budget Committee about what truly is going on with the requirement for new outpatient civil certifications, for new protective placements, and any additional civil commitments and enhance protective placements. So again, it just cuts this in half. That's why there's a bunch of numbers here. It does not eliminate the funding for the capital outlay that is necessary. It does not eliminate any funding for the IT infrastructure that is needed to get in place to make this bill work the way we're hoping that it works. So I would ask for an aye vote. That's simply what it does. And again, I ask for an aye vote.

Thank you, Mr. Chair. Couldn't agree more, and look, we're in a little bit of uncharted territory. Just trying to figure out how big is the population we're trying to serve, which generates a lot of uncertainty in the budgetary request and the fiscal analysis. Some estimates are, you know, 60 to 70 folks. Some estimates are 20 or 30 folks. somewhere in the middle maybe is where we landed. So I'm in full support of Amendment 49. There's still a correction process. Entities, departments can go through. If we miss the mark somehow, we find out something differently next year. That's why we go through supplemental. So I'm in full support of Amendment 49.

So as a continuing part of the conversation around the previous amendment, we are in uncharted waters. And so in the original negotiations, we put in the bill an over-spenditure authority for Department of Human Services. But because we don't know what's going to happen, And we don't know how many people we're going to end up needing these placements for. But that also, and there's a big difference between what the department thinks, even in the fiscal note there's a departmental difference, but there's a big difference between what could happen and what is actually in the fiscal note for this population. But we have worked out something which hopefully will bring tomorrow as a technical amendment on third reading, you can boo now, that will provide a different solve for that and make it easier for the department to come in and get authority to spend more on this if indeed we need that. And so this strikes the overspend authority, and I ask for a yes vote.
