Thank you for joining us. As you know we had some comments on this matter regarding concerns about the retention timeline for call recordings Can you explain to the department I sorry to the committee what that matter is concerning and what the department intends to do about it

Jay Heinz Shahwitness

I'd be happy to, Chair. The rule before the committee today is changed to Section 170 of the department's rules for student loan servicers, and that lists items that are considered books and records and must be retained. And we are adding call recordings to that list. Unfortunately, not before the committee today is the retention period. That's in a separate rule. That's in Section 180, and it specifies a period of time that depends on when the loan has been repaid or transferred to another servicer. And so we received comment during the first notice period from an industry association that wanted more certainty as to sort of a cap on a number of years, the maximum that call recordings should be maintained. And we were certainly willing. We were in the middle of discussions with that, and they were going to present us some options and some information about the number of small businesses that may be impacted. Those discussions just sort of dried up, but our proposal is that we're prepared to proceed immediately with a modification to Section 180 that would establish a sort of maximum time period. It can be when the loan transfers or is repaid or X number of years. It's probably going to be six years is our recommendation for call recording to be maintained. And we would make that consistent. We wouldn't have a separate time period for calls that were started like August of this year and then a different one in, say, November or whenever the new rule becomes final. We intend to make it applicable across the board. The reason we want to have at least five or six years is because that sort of aligns with the examination cycle. We have approximately 40 student loan servicers, and it takes several years to examine them all. And as we've kind of discussed with staff, we find these quite valuable in identifying servicing problems on occasion. And we also do this on the mortgage side. but this is an important rule to the department and we're committed to coming back with a second rule to kind of establish that maximum time frame for call recordings to be kept. Sorry, that was probably a little longer than you were expecting.

Velaother

No, thanks for following us in and we encourage you to continue to work in the cooperative spirit you just outlined and we look forward to seeing that rule in the future. Thank you.

Jay Heinz Shahwitness

Thank you very much.

Next, we're going to move to the Health Facilities and Service Review Board. That's tab three, entitled Narrative and Planning Policies, as well as tab four, Processing Classification Policies and Review Criteria. Staff, please read the motion. Jake, I'll with the concurrence of the Health Facilities Services and Review Board. Extend the rulemaking's title narrative and planning policies and processing classification policies and review criteria for additional 45 days. Senator Harris moves and Senator DeWitt seconds that the motion just read be approved. All those in favor say aye. All those opposed say nay. The ayes have it and the motion passes. So we have an added item, tab 8 from DPH regarding Stroke Center certification. Do we have someone from DPH who can come to the witness table, please? If you could identify yourself for the record.

Elise Wenglerwitness

Thank you. Hi, I'm Elise Wengler, Legislative Liaison with IDPH. We're going to need a little more time to work on this.

Velaother

Would the department agree to an extension on this rulemaking?

Elise Wenglerwitness

Yes.

Jay Carrother

Thank you very much. Thank you. With that, staff, please read the motion. Jay Carr with the concurrence of the Department of Public Health extend the rulemaking titled emergency medical services, trauma centers, pediatric emergency and critical care centers, stroke centers, hospital code for an additional 45 days. Representative Reich moves and Senator Castro seconds. The motion just read be approved. All those in favor say aye. All those opposed say nay. In the opinion of the chair, the ayes have it. And the certification motion passes. Now to the complaint review. We have a complaint review found at tab 22 that will be postponed and placed on JCAR's August agenda. We'll move to the certification of no objection. Staff, please read the certification motion. The committee shall inform the agencies whose rulemakings the committee has not voted in objection or extension or did not remove from the no objection list that the committee considered their respective rulemakings at the monthly meeting and, based upon the agreements for monocation and the rulemaking made by the agency, no objections will be issued. Representative Haas moves and Representative Tarver seconds that the certification motion just read be approved. All those in favor say aye. Opposed nay. In the opinion of the chair, the ayes have it. And the certification motion passes. JCAR's next meeting will be held on Wednesday, August 19th, 2026 at 1030 a.m. in room C1 of the Stratton Building in Springfield, Illinois. With no further business to come before the committee co-chair, Spain moves. and Representative Haas seconds that the meeting of the Joint Committee on Administrative Rules stand adjourned. All those in favor say aye, oppose nay, and depending on the Chair, the ayes have it, and the committee stands adjourned. Thank you.
