Terms of Service

These Terms of Service ("Terms") govern your use of Gavelin.ai and its related services, including the website, API, and MCP server (collectively, the "Service"), operated by Gavelin.ai ("Gavelin," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Account Registration

You are responsible for maintaining the confidentiality of your account credentials, including API keys. You must promptly notify us at hello@gavelin.ai if you become aware of any unauthorized use of your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Circumvent rate limits or other usage restrictions
  • Resell, redistribute, or sublicense access to the Service without written permission
  • Use automated tools to scrape or bulk-download data beyond normal API usage
  • Misrepresent your identity or affiliation when using the Service

4. Service Description

Gavelin provides access to legislative data, including bills, hearing transcripts, vote records, and legislator information sourced from public government records. The Service is available via a web application, REST API, and MCP server.

5. Subscriptions and Payments

Paid plans are billed monthly or annually through Stripe. All fees are non-refundable except as required by law. You may cancel your subscription at any time; access continues through the end of your current billing period.

We reserve the right to change pricing with 30 days' notice. Price changes do not affect your current billing period.

6. API and MCP Server Usage

API and MCP server access is subject to rate limits based on your plan. We may suspend or revoke API keys that exceed rate limits, are used abusively, or violate these Terms. API keys are confidential and must not be shared publicly or embedded in client-side code.

7. Data Accuracy

Legislative data is sourced from public records and third-party APIs. While we strive for accuracy, we do not guarantee that the data is complete, current, or error-free. The Service is not a substitute for official legislative sources. You should verify any information before relying on it for legal, policy, or advocacy purposes.

8. Intellectual Property

The Gavelin name, logo, website design, and proprietary software are owned by Gavelin.ai. Legislative data provided through the Service is sourced from public government records and is not subject to our copyright claims.

You retain ownership of any content you create using the Service (reports, analyses, saved searches).

9. Limitation of Liability

To the maximum extent permitted by law, Gavelin and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service is limited to the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms, with or without notice. You may delete your account at any time. Upon termination, your right to use the Service ceases immediately.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Colorado, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the state or federal courts located in Denver, Colorado.
